flowerAs many know, because Minnesota is a no fault divorce state, one spouse not being ready does not need to stop the process from moving forward. The ready spouse can file for divorce and the process moves on in court with little control of the reluctant spouse. A potential client recently came in for a consult and, as often is the case, her husband was struggling to move forward in the process. They were at very different points on the divorce readiness scale – she was ready, he was not. This is quite typical. The other spouse is sometimes called “reluctant” or “in denial.” When one spouse is looking for a non-adversarial, out-of-court alternative (like mediation or collaborative divorce), there is more of a need to bring that other spouse along. The reluctant spouse really can delay the process and interfere with the non-reluctant spouse’s desire to divorce. This potential client said something very interesting to me. She said, “I know I am committed to collaborative divorce, but I am learning that this does not have to be a collaborative decision.” This realization was profound. She realized that she could control the process (with her husband’s agreement), even if her husband never agrees with the decision to divorce. It is common during the divorce process to have spouses be at different comfort levels with the decision to divorce. These levels of readiness can change throughout the process and even vary greatly from one meeting to another. The challenge often lies with helping the reluctant spouse commit to a collaborative process, while acknowledging his or her disagreement with the process. A good collaborative attorney can strategize ways to bring the reluctant spouse into the process and help move things forward. flowerIn the early days of separation and divorce you may find the idea of growing from your divorce difficult to believe. You may be in a state of depression or denial wondering how your life will carry on, much less that you will grow from this life change. It may be difficult to find the silver lining, yet the simple truth is that you can (and will) grow from this. You may or may not have had much of a choice in whether or not you are getting a divorce, but you DO have a choice whether to grow up or grow down through this process. In a bad or difficult marriage it is easy to see how a person might grow from getting a divorce, but all divorces bring the opportunity for growth. Your divorce will likely change the way you view the world. Your life may be functioning completely different than before. Maybe you are having to look for a new career or add a part time job to make ends meet, or maybe you’ve been out of the workforce for years and your divorce is forcing you back in. Maybe you’ve had to move to an apartment or back in with your parents or a friend. Maybe your kids are at a new school as a result of your divorce. Maybe your entire social circle has now changed. It’s how you view these changes and react to your new normal, that promotes growth. Growth from your divorce can appear in a number of ways. Emotionally, spiritually, physically, etc. Even something as simple as learning a new skill that your spouse had always managed like trimming the shrubs, or online bill pay. Spiritually your faith might deepen or may struggle as you get through some trying times. Emotional growth may take a bit longer. There may be some dark and difficult days before you start to grow emotionally, but slowly it will happen. Your priorities will change and grow. If you have shared custody with your children you will likely start to value your time together all that much more. Some things that were priorities during your marriage may no longer hold a significance to you. Growth after divorce becomes a way to cope. Growth after divorce becomes a way to survive. Growth after divorce becomes empowerment. Growth after divorce becomes a new, better you.
question markWhen getting divorced, it is important to have a support network.  Having a sounding board and friends to talk through things with can help you evaluate options.  They can remind you that you are not alone.  Acquaintances who have gone through divorce themselves or who have certain expertise (like financial or real estate), may be able to help you with some of the decisions. Everyone needs someone to talk to. However, sometimes well-intentioned people can cause more harm during the divorce process than good.  Everyone seems to have a neighbor that somehow obtained a “better deal” than you did.  They either received more in settlement or support than you are considering or they paid less than you.  This “Greek Chorus” phenomenon can slow down progress and make a collaborative process more difficult than it needs to be. When reaching out to others for support during divorce, keep the following things in mind:
  • Remember that you live with your resolutions.  If something feels right to you, it might be best to not let your friends talk you out of it.
  • You can always ask your support network to just listen.
  • Figure out how you feel after talking through things with certain friends – if it doesn’t make you feel better or more positive about resolutions, they may not be the best support.
  • If you ask for advice, be very specific about what you are asking for and let your support know that you may not take their advice, you are just gathering information.
  • Be careful if you seek advice on one piece of the settlement without considering all elements.
  • You can always use your collaborative attorney as your sounding board instead of peers.   Your friends and family can support you in other ways.
question markMy husband and I were taking our kids to swimming lessons when we saw a man and woman standing outside the facility arguing.  The anger and negative energy were palpable.  While still in the parking lot, we met up with another family we know, and we exchanged uncomfortable glances as the conversation between this couple became more heated.  “Awkward,” my friend whispered. As we approached, I could hear what they were arguing about, and the expletives were flying (this is a family place, mind you, and my kids were five and two at the time – yikes!)  The woman was saying, “I don’t give a $*&^ what you think.  You can’t have that #$&* sleep over when it’s your weekend with our son.  You are such an ^*&+@!  We aren’t even divorced yet.”  My five year old glanced up at me with an odd look on his face.  Oh boy.  I wondered if they had attorneys and what process they were using. Even though I see this sort of conflict on a regular basis, it was very uncomfortable to witness.  I’m not sure if my discomfort was because I couldn’t do anything about their conflict (I was there as a mom, not a lawyer) or because my children were in earshot.  For a fleeting moment I did, however, consider going up to them.  I felt compelled to inform them there is a better way to deal with this “stuff” and that a child specialist and divorce coach could get them to a better place regarding “adult sleepovers.”  That was the lawyer in me. Since we were running a bit behind, however, the mom in me picked up my two-year-old and hurried my son through the door.  Either way, I felt bad for this couple, and even worse for their child.  I wondered how old their son was and if they had made a scene near the pool when they decided to “take it outside.”  I will never know how their divorce turned out.  I can only hope that things cooled down at some point so they could focus on co-parenting their child.  It’s understandable that emotions are highly charged during a divorce, which is the reason a divorce coach and child specialist are incredibly helpful during the process, as well as a therapist or counselor.  Stop.  Breathe.  Think.  And talk to a mental health professional.
Facebook AppMaking online connections is easier than ever with modern social media apps. It is not necessary to know someone at all, let alone to know them well, in order to see their profiles and get an idea of who they are and what kind of life they lead. In times before this technology, community life and networking were very different. Getting to know someone happened face to face, and gossip was spread by word of mouth. With everyone having technology in their pockets these days, deciding who is relevant to your life seems like an easy task. The everyday interactions we have with people while out and about are often with perfect strangers, and not many of us put much effort into these encounters. Treating any person you meet with respect and dignity is a basic human courtesy, but in the midst of our busy schedules, we often forget this. In All I really Need to Know I Learned in Kindergarden, author Robert Fulghum sums up relationships in communities like this:
“Without realizing it, we fill important places in each other’s lives. It’s that way with the guy at the corner grocery, the mechanic at the local garage, the family doctor, teachers, neighbors, coworkers. Good people who are always “there,” who can be relied upon in small, important ways…. And, of course, we fill that role ourselves. There are those who depend on us, watch us, learn from us, take from us. And we never know.”
If you assume your neighbor is not relevant to you, you may never realize who they actually are. Paying attention to the real people that live down the street is just as important – more important – as curating an impressive list of LinkedIn connections or Facebook friends. Consider making a connection with the person behind the online profile.
Those married, and especially with children, might dream of having a quiet Saturday night to themselves, but for many divorcees, especially those newly divorced this new “free time” can be especially lonely. You might not be ready or wanting to jump into dating, but being home alone frequently can be rather lonely during those early days of divorce, whether the kid’s are at your ex’s house, grown, or you don’t have any. We put together a list of ideas to get you started to help pass the time.
  • Exercise – Whether you prefer to exercise solo, or would like to make it a social activity by joining a gym or a running/swim/etc. there is no better time to get fit than on these lonely days. The endorphins will instantly boost your mood and you’ll gain extra side effects like weight loss, strength, and confidence!
  • Reading – If you don’t already love to read, keep trying – surely there is something out there that will peak your interest to keep reading! Join a book club if you want to make it a social activity. Not sure where to find one look online or start one – ask friends and neighbors with similar interests if they would like to join. You can rotate the meeting space/host each month to keep it fun and interesting!
  • Explore your town – play tourist in your own town, get lost in a bookstore, see when museums and arboretums have free admission days. Check into free classes and groups at your local library, many offer events like adult coloring night, crafts, and cooking. In addition to children’s activities, Community Education through the school districts also offer adult activities.
  • Cook – try new recipes, or maybe just save them on Pinterest for another day. If cooking for one person doesn’t interest you, perhaps make a monthly standing date with a parent/friend/sibling where you have them over for dinner and conversation. If baking is more your style, but you don’t want all of the sweet temptations around, take the treats to a nursing home, shelter, police precinct, etc.
  • Start a new hobby – maybe you haven’t picked up a paintbrush since high school art class, or dusted off that old sewing machine great Aunt Edna passed down to you years ago, but find something that peaks your interest. All the better if you’ve never done it before. Now days you can find a video tutorial for just about anything on the internet, which even makes home projects that you may have never considered DIYing possible. Hobbies like painting or sewing are difficult to start and stop when the kids are around, so those perfect projects for these lonely days.
  • Part time job – if you could use the extra cash there is no shame in getting a part-time gig. Even if you don’t necessarily need the money and are just looking to fill the time, find something you enjoy doing and set the money aside for a vacation! Even direct sales can provide a fun, no pressure, no schedule way to earn some extra cash and socialization too!
  • Volunteer – The options for volunteering are endless so find something that you are passionate about and look into how you can help.

As the sun comes out and the temperatures rise, flowers blossom and buds sprout.  People are out exercising and enjoying the warm weather. After a long, cold winter, as the days get longer, the community collectively is re-emerging. It is an optimistic, forward-looking time. There are a number of similarities to Springtime and the re-emergence after a divorce.  When someone initiates a divorce, it often causes the fear and negative emotions to increase. There is added anxiety in the process, knowing that you have started but not yet really resolved anything. The divorce itself may feel like winter.  You may feel isolated to stuck in a lonely process. You may have a hard time appreciating the positive things in your life and instead focus on the cold, scary parts. But once resolutions are found, it is a new beginning. Indeed, a collaborative divorce process (where both clients work together out-of-court on resolutions) can lead to meaningful resolutions that establish a great foundation for the future. Mutually acceptable resolutions and a process that supports and nurtures both spouses, can lead to a new normal.  Once in place, those resolutions can feel like a whole new life. Like Spring, it can feel like the future is positive and there is potential for emotional and financial success. Relationships can feel refreshed or reinvigorated. People may have better mental health and feel good about moving forward. Like an extra bounce in your step or deeper peace — re-emerging from divorce has great possibility. There are options when you are divorcing. The collaborative process is a truly future-focused process that supports you during the process and then sets you up for success afterwards.  So, if you are contemplating divorce, know that it gets better. There is a springtime waiting for you.

While it’s important to have a positive outlook on the year ahead, sometimes the changing of the calendar year can create a false sense of promise. Pressure to set unrealistic goals such as being healed from your divorce this year, or that you will fall in love this year. Sometimes while going through the difficult path of grieving your divorce it may be helpful to consider that January 1st is nothing more than the day after December 31st. The changing of the year will bring a bit more healing and personal growth as each day passes, however it is imperative to understand that things can’t, and won’t, change overnight, which is why creating realistic expectations of the new year is essential to your healing. All the talk about new year’s resolutions, goals, “new year, new you,” that come with the month of January can leave you feeling overwhelmed, which creating realistic expectations, even if that means lowering or having no expectations at all can be a healthier way to navigate the healing process. Setting lower expectations allows you to be gentler on yourself. Creating a sense of balance in your life can be far more important than checking something off of an overwhelming, or unrealistic, to-do list. As you gradually adjust to your new normal, you may feel that everything in your world is now different, yourself included. You will have days of triumph, days of defeat, and plenty of temporary setbacks throughout the year ahead, but it’s crucial to remember that these temporary setbacks are just that – temporary. They happen to everyone and are a normal part of the process of healing from your divorce. It’s natural to have days where you hope and pray for everything to go back to the way things once were, but it is unrealistic to expect for that to actually happen. As you begin to accept your new normal, it might require a new approach to life, and maybe your biggest goal for 2016 will be to learn that approach and how to navigate it. Find the joy in life, which is more important than checking something off of a list. Reconnect with old friends, find new hobbies, look for the joy in everyday, but don’t feel the pressure to have a timeline on your healing, your happiness, your life, or finding new love.

For families who have divorced, the new year often symbolizes a new beginning.  It is a time to establish a new norm. As a collaborative attorney, I often help guide families through divorce in respectful and supportive ways. I often hear from clients that they have goals and resolutions for a new year. Here are three common resolutions for families of divorce and ways all families can incorporate these values in their lives:
  1. Establish financial independence and security. Entering a new year is a time when finances are now truly separate – with no tax connections.  Be mindful of what you spend.  Track your expenses and see how they match up against your projected budgets and income.  Get a financial planner or, on your own, map out your financial goals for the year, including personal savings, retirement, and investment management.
  2. Embrace co-parenting. Children thrive with routine and care.  They love to be listened to and enjoy one-on-one time with both parents.  They also sense stress and tension.  As you establish routines and the children spend time with both parents, remember to treat the other parent with compassion as well. Avoid fighting in front of the children and support the time that they spend in both homes. Also learn to enjoy your off-duty time.  When you don’t have parenting duties can be a great time to focus on yourself and prepare for your next parenting day.
  3. Take care of yourself.  As parents, workers, and functioning members in society, we often spend our tie focused on others.  We take care of the children and our work obligations, but we often forget our own self-care.  Use the new year to establish work-out routines or start exploring a new hobby.  It is never too late to start improving yourself and the new year is a perfect time to make that effort.
